Default California: Counties File Briefs Seeking To Overturn State Medi-Pot Law

San Diego, CA: Lawyers for the counties of San Diego and San Bernardino filed legal briefs this week urging the Fourth District Court of Appeals to overturn a 2006 ruling upholding the legality of California’s medical cannabis law.

The counties argue that they will "suffer harm if they are required to comply with [the state’s] medical marijuana laws."

For years, both counties have refused to issue identification cards for state qualified patients – arguing that doing so would be in violation of federal drug laws. Under California state law, county health departments are required to establish a voluntary registry and identification card program for authorized medical cannabis patients.

A previous San Diego Superior Court ruling had determined that the state’s ID card program was not in "positive conflict" with federal drug laws.

Oral arguments in the case are expected later this year.

The case is County of San Diego v San Diego NORML.

obey your damn state laws and give a flying f**k about what the DEA threaten you with/quiet cooperating with them! state law is written by the people (at least there is a chance for that) federal law is written by the lobbies of industry!

...i just love it when the lawyers enter the game - life would probably flourish without that trade if everyone could just act fair and decent again.

well spoken green nobody you hit the nail on the head...

At least the people can control the states but the feds is a lost cause... term limits would do wonders to clean that up.

I think within 10 years you will see the military protrolling the streets of the major cities. The feds have let this country get so out of control.

Remember Kent State... scarey ain't it...

Kent is one of th prime example for what will happen if military force is used to suppress the voice of the citizens - mayhem and mass murder. the cynical about the massacre of Kent State University is that big government just used the same form of governmental violence they been officially fighting in Asia at that time (Stalinism) - leave alone that we trade today with those that once been our "worst" enemies.
