hi there everyone!
I'm contemplating a move out to oregon in roughly a years' time, and I intend to make full use of the state-given opportunity to grow my own medicine. I have doctors and nurses in my family, but since I'm about as smart as a bag of hammers, I cant really pursue a career in medicine.
that said, oregon has probably the best laws in the country regarding the ability to grow medicine for others, so maybe I can contribute to someone's treatment and recovery after all. I have a few questions about growing for others, though. I managed to read most of the actual legal statute stuff, but there are a few things I'm not clear on. this is all from memory - I cant find the super useful state by state law thread that I was reading yesterday on GP.
- the law states that a registered grower may recoup monies matching their utility expenses for each grow for a patient. say you're growing for 4 others, the max allowed by law - how do you fairly assess each patient's cost? does the state set forth a set rate which can be applied on a case by case basis?
=====================================
you take the harvest divide by the cost and there you go...
that being said there are no set rules.
we always reccommend a contract between p.r.m.g.(grower) and patient.
some gardens have one who foots most if not all of the expenses and the rest do what they can.
=====================================
- the law also states that the grower cant be paid for labor, etc. which is fine w/me, honestly - compassion and help shouldnt necessitate payment every time. but, are tips or gifts allowed? like, the patient you grow for is especially happy with a harvest, and wants to give you more money - where does the law stand on that? and, for clarity, I DO NOT mean "forced" or "implied" tips or gifts that could be construed as necessary for continued production.
=====================================
tips are acceptable however karma will bless you way more in life.

- oregon law seems to indicate that there are no reciprocity agreements with other MM states. i.e., if I were pulled over and searched in california, I could be arrested/charged for possession even if I had a MM card from oregon and was in posession of a "legal" amount of cannabis as the law in california dictates. is this accurate?
=====================================
the only state with reciprocity is good ol montana.
there is no legal amount across state lines.;-)
=====================================
- back to growing for others: do you all who grow for patients need to form not-for-profit organizations to have your utility reimbursement be "legit?" what's necessary to set up a NFP in oregon?
=====================================
not sure i am not a nfp lawyer.
=====================================
I know that's a lot to ask, and I'd be quite thankful to just be pointed in the direction of available info on these topics - I dont expect you to answer every question in detail if you dont want.
thanks!
