Default LA Clinic owner arrested

Los Angeles Times

LOS ANGELES — The owner of six Los Angeles-area medical-marijuana dispensaries was arrested by federal agents Tuesday after an investigation sparked by a traffic accident in which a motorist allegedly high on the dispensaries' products plowed into a parked sport-utility vehicle, killing the driver and paralyzing a California Highway Patrol officer.

After the Dec. 19, 2007, accident, investigators found "a large amount of marijuana and marijuana edibles" in the pickup driven by the suspect, Jeremy White, 20, according to federal authorities.

Investigators traced the marijuana to the Holistic Caregivers facility in Compton, one of six dispensaries owned and operated by Virgil Grant, 41.
Federal Drug Enforcement Administration (DEA) agents set up undercover buys at each of the facilities in which an operative with "no serious medical ailments" was sold medicinal marijuana, according to an affidavit filed in U.S. District Court in Los Angeles.

Grant and his wife, Psytra Grant, 33, were arrested Tuesday at their home in Carson after being charged in a 41-count indictment returned by a federal grand jury last week.

The sale of marijuana for medical purposes is allowed under California law. But federal law bans its sale under any circumstances. Federal authorities tend to prosecute cases in which dispensaries are not in compliance with state law or in which there is some other aggravating factor.

White was charged with gross vehicular manslaughter and is awaiting trial.

It's not the job of the dispensary to check for people's ailments, you can't tell if a man has cancer by looking at him! That's the damn Doctor's job, It's only going this far cause the guy hit a cop.Geez, it'd seem like california would just boot out all of the DEA agents by now. all they do is go after loopholes and trick people. I'm not gonna do it, but they all need a good bat to the head so they won''t bother us anymore. If only revolting wasn't a crime nowadays..

In Canada there is a law against Entrapment. If proven the case can be booted out. Not sure about the laws in the U.S.

Well shouldn't the client provide proof of the ailment in some form? I used to have prescriptions all the time for certain kind of medications. Although I no longer have them and the doctor still calls, they are prescribed for certain things. I have disposed of everything just in case because they are outdated I do not want trouble but to switch over to another kind of medication I believe the person who provides the alternative would want to see the pill bottles, prescriptions, etc. just to make sure and protect their interests. I seriously doubt Mr. White was under the influence of marijuana and most likely intoxicated with alcohol which is one of the largest contributing factors to death by car accident in the world.

Wow. Using this logic, the owners of every alcohol distributor in the country could be indicted for selling someone alcohol if the purchasers then get in an accident. If you over serve someone at a bar it is one thing, but I fail to see how the owners of the distribution center are accountable for how/when the product is used.

Does a pharmacist run the same risk if I pick up my prescription, then take too many pills and drive into a cop and parked car?

The point in the indictment that indicates undercovers were purchasing MJ for "no serious medical ailments" makes me laugh too. 1/2 the people on prescription medication don't have "serious medical ailments" either. Most of them are just addicted and can't quit... and who would want them to? Certainly not the Pharmecutical companies who make all the $, then line the pockets of the politicians by way of donations.

I live in CA. Kieahtoka you are right, the Dr. not the clinic checks your medical reason. BUT in my opinion there too many Dr.'s out here giving referrals to anybody thats got $150.00. My Dr. requires you to have documintation proving a medical condition before she will give a referral. A friend of mine got one with-out any paprework at all. (Different Dr.) He said the people were lined up around the block, and most looked pretty healthy. Mostly were kids (20 year olds). The feds will use any excuse to disobey our CA. law.

GG- If a bartender sells you alcohol when you are drunk, then get in a wreck, he is libel. But drunk driving is different then driving when medecated. I thought there were some tests done that showed that driving when medicated caused no impairment.

If you think you can drive stoned with no impairment, you're just as bad as those who think they can drive while drunk. No one should EVER driver while intoxicated, whether it's alcohol, marijuana, or even Benedril. You know that "Do not operate heavy machinery..." warning on some medicines? The same applies to marijuana.
